The Neutral has rendered a decision on the BNSF Availability Policy.

The Award

  1. The Work/Rest Guidelines/Principles did not vitiate BNSF’s management prerogative to unilaterally regulate attendance through the issuance of the 1999 Availability Policy.
  2. Provisions in existing collective bargaining agreements do not bar BNSF from issuing the 1999 Availability Policy.

You have a right to have union representation if a carrier officer wants to speak with you regarding availability. Demand it!

Vacation Requests

Do not use the On-line Vacation request on TSS. Fax all Vacation requests to Fort Worth and make a copy for your Local Chairman.


Pay Shortages

Remember if your pay shortages total over a basic day you are entitled to a time check. Let me know if you are not made whole by November 15, 1999.

Company Sponsored Programs

In light of the recent decision on availability the UTU will maintain its current position on company sponsored programs.

Rules Compliance

With the BNSF getting a favorable decision on Availability the BNSF will most likely have an attitude that they can do anything they want. Comply with all work rules and schedule rules
