To : All Members Claims September 13, 1998
The BNSF is getting very rigid on application of our rule concerning time limits on appealing claims.
Rule 65 {c} of the SP&S Schedule
If a disallowed time slip is to be progressed as a claim the Local Chairman shall, within sixty (60) days of receipt of declination notice, advise the Superintendent in writing his reason for rejecting his decision, furnishing a statement of facts as he understands them. If the provisions of this paragraph are not complied with the claim will be considered abandoned.
Please provide me with the following items (all at once please).
- Copy of your payroll printout
- Copy of your timeslip {paper or PST printout}
- Copy of delay report and any other information that supports your claim.
Give me your claims as soon as possible. I need time to research your claim and write up your claim.
DONT let the BNSF get away with not paying any claim that is supported by our schedule. The carrier banks on people getting mad and not making an attempt to collect payment. I conference claims once a month with the carrier. I have been posting updated lists of my claims file after each conference. Also any valid claim that can not get resolved locally is sent to the General Chairman for further appeal.
